PARTICIPANT WAIVER & RELEASE OF LIABILITY

DMS Farm Friendzy Festival

Event Date: March 7, 2026

Location: Desert Marigold School | 6210 S 28th St | Phoenix, AZ 85042

ASSUMPTION OF RISK

I understand that participation in the Farm Friendzy Festival (“Event”) involves physical activity, including running or walking, and may involve risks such as, but not limited to: falls, collisions with other participants, uneven surfaces, weather conditions, dehydration, and other hazards associated with outdoor physical activity on a school campus.

I knowingly and voluntarily assume all risks, known and unknown, associated with participating in this Event.

RELEASE & WAIVER OF LIABILITY

In consideration of being allowed to participate, I, on behalf of myself, my heirs, assigns, and personal representatives, hereby release, waive, and discharge:

  • Desert Marigold School
  • Its governing board, officers, employees, contractors, and volunteers
  • Event sponsors and organizers
  • The charter authorizer (if applicable)

from any and all claims, liabilities, demands, actions, or causes of action arising out of or related to any injury, illness, death, or property damage that may occur as a result of my participation in the Event, to the fullest extent permitted by law, including claims arising from ordinary negligence.

MEDICAL ACKNOWLEDGMENT & CONSENT

I certify that I am physically fit and have no medical condition that would prevent my safe participation in this Event.

I grant permission for Event staff or emergency personnel to provide medical treatment in the event of injury or illness, and I understand that I am responsible for any medical costs incurred.

RULES & CONDUCT

I agree to:

  • Follow all Event rules and instructions
  • Remain on designated routes
  • Conduct myself in a safe and respectful manner
  • Acknowledge that the Event may be delayed, modified, or canceled due to weather or safety concerns

I understand that failure to follow Event rules may result in removal from the Event.

PHOTO & MEDIA RELEASE

I grant permission to Desert Marigold School to use photographs, video recordings, or other media of me taken during the Event for promotional, educational, or fundraising purposes, without compensation.

FUNDRAISING ACKNOWLEDGMENT

I understand that this Event is a fundraiser benefiting Desert Marigold School, a 501(c)(3) nonprofit organization. Any entry fee or donation may be tax-deductible to the extent allowed by law.

SEVERABILITY

If any portion of this waiver is held to be invalid, the remaining provisions shall continue in full force and effect.
